Welcome to WattVue LLC (“WattVue,” “we,” “our,” or “us”). These Terms of Use govern your access to and use of the WattVue monitoring platform, website, mobile applications, software, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms of Use. If you do not agree, do not use the Services.
IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION
THESE TERMS OF USE REQUIRE YOU TO RESOLVE MOST DISPUTES WITH WATTVUE THROUGH BINDING INDIVIDUAL ARBITRATION AND NOT IN COURT, UNLESS YOU EXERCISE YOUR RIGHT TO OPT OUT OF ARBITRATION WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS. THIS MEANS YOU WAIVE YOUR RIGHT TO A JUDGE OR JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT. SEE SECTION 13 BELOW FOR COMPLETE DETAILS.
1. Description of Services
- Real-time solar system monitoring
- Real-time production and consumption analytics
- System error notifications and alerts
- Remote troubleshooting and diagnostics
- Communication and coordination with manufacturers
- Scheduling repair or replacement services
- Web and mobile platform access
- Historical performance reporting
- WattVue does not manufacture solar equipment and does not guarantee uninterrupted system operation or energy production.
2. Eligibility
- You own or are authorized to manage the monitored solar system;
- The information you provide is accurate and current; and
- Your use of the Services complies with all applicable laws and regulations.
3. Subscription Plans and Billing
WattVue offers recurring subscription services billed monthly or annually.
Free Trial
- The free trial lasts for one (1) year from activation;
- Billing begins automatically at the end of the trial period unless canceled prior to renewal
Subscription Fees
Current pricing may include:
- Dashboard Setup Fee: $0
- Monthly Subscription: $359.88 after trial period
Subscription pricing may change from time to time. We will provide advance notice of material pricing changes.
Payment Authorization
By subscribing, you authorize WattVue to charge your selected payment method on a recurring basis until canceled.
If a payment fails, we may suspend or terminate access to the Services.
4. Cancellation and Termination
- Cancellations become effective at the end of the current billing cycle;
- No partial refunds or credits will be provided for unused periods.
- You violate these Terms;
- Payments are overdue;
- We suspect fraud, abuse, or unauthorized use.
5. Monitoring and Support Limitations
WattVue provides monitoring and support services based on available system data and third-party equipment integrations.
You acknowledge and agree that:
- Monitoring accuracy depends on equipment connectivity and manufacturer data availability;
- Internet outages, hardware failures, manufacturer restrictions, or third-party service interruptions may affect monitoring performance;
- Remote troubleshooting may not resolve all issues;
- On-site service visits may incur additional charges unless covered under a separate agreement.
WattVue does not guarantee uninterrupted operation of your solar system or uninterrupted access to the
Services.
6. Repairs and Third-Party Services
- Share necessary system information for troubleshooting purposes;
- Coordinate service requests and warranty claims where applicable.
- WattVue is not responsible for:
- Manufacturer warranty decisions;
- Delays caused by third parties;
- Defective equipment;
- Third-party workmanship.
7. User Responsibilities
You agree to:
- Maintain accurate account information;
- Provide reasonable access for service appointments if necessary;
- Maintain internet connectivity and compatible equipment;
- Use the Services only for lawful purposes.
You may not:
- Reverse engineer or interfere with the platform;
- Attempt unauthorized access;
- Use the Services in a manner that disrupts system operations.
8. Intellectual Property
All content, software, graphics, logos, dashboards, reports, and technology associated with the Services are owned by WattVue or its licensors and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Services for personal or internal business purposes only.
9. Disclaimer of Warranties
The services are provided “as is” and “as available” without warranties of any kind, whether express or implied.
to the maximum extent permitted by law, wattvue disclaims all warranties, including:
- merchantability;
- fitness for a particular purpose;
- non-infringement;
- accuracy or availability of data;
- uninterrupted or error-free operation.
10. Limitation of Liability
To the maximum extent permitted by law, wattvue shall not be liable for:
indirect, incidental, special, consequential, or punitive damages;
- lost profits;
- lost energy savings;
- business interruption;
- data loss;
- equipment failure.
wattvue’s total liability arising from or related to the services shall not exceed the amount paid by you to wattvue during the twelve (12) months preceding the claim.
11. Indemnification
- Your use of the Services;
- Your violation of these Terms;
- Your violation of any applicable laws or third-party rights
12. Privacy
Your use of the Services is also governed by our Privacy Policy.
WattVue may collect system performance data, account information, and device information necessary to operate and improve the Services.

Agreement to Arbitrate
You and WattVue agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration rather than in court, except for small claims matters that qualify.
Class Action Waiver
You and WattVue agree that disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Arbitration Rules
Arbitration shall be administered by the American Arbitration Association (“AAA”) under its applicable rules.
Opt-Out Right
You may opt out of this arbitration agreement by sending a written notice to:

Your opt-out notice must be received within thirty (30) days of first accepting these Terms.
Governing Law
These Terms shall be governed by the laws of the State of Hawaii, without regard to conflict of law principles.
14. Changes to Terms
We may update these Terms from time to time. Updated Terms become effective upon posting.
Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

Acceptance of Terms
By accessing, registering for, subscribing to, or using the WattVue Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.
If you are using the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, and “you” and “your” will refer to both you and that entity.
If you do not agree to these Terms, you may not access or use the Services.
To proceed with activation of the Services, you must reply to the applicable service or onboarding email confirming your acceptance of these Terms and submit payment of the applicable invoice. Your continued use of the Services following such confirmation constitutes acceptance of these Terms.
Your continued use of the Services following any updates or modifications to these Terms constitutes your acceptance of the revised Terms.
You may also be required to accept additional terms, conditions, or policies applicable to specific features, integrations, subscriptions, or services offered by WattVue. In the event of a conflict between these Terms and any additional terms, the additional terms will govern solely with respect to the applicable feature or service.
